Distressing, Indeed
Today's NYTimes editorial
The Obama administration professes to oppose the odious and misguided policy of banning gay soldiers from serving openly in the military. So it was distressing to hear that the Justice Department plans to appeal a federal court order that the military immediately stop enforcing the law that is used to drum out gay service members once their sexual orientation becomes known.
Meanwhile Secretary Gates announced that the military will abide by the judge's order pending further legal outcomes.

This is despicable. I've supported Obama thus far, agreeing with the viewpoint that he is and always was a moderate, and that he was never the liberal others thought he was and that I would have liked him to be. This could be what turns me against him though.

Whoops, jumped to conclusions I think. It still seems Obama wants to end DADT....

Yeah he is still for it ending it, and I believe him. But this seems like an awfully cautious route, when maybe a move showing a little more boldness might be in order. Does DOJ have to defend the law? Certainly the state of California decided not to defend the Prop 8 law when they thought it was unconstitutional, and the DOJ could stay out of it on the same ground. I guess they must think the law is constitutional and just want it changed, and want to push it off on Congress. Which sounds great except for Congress couldn't get it done and are on the verge of getting more conservative, so what are the odds going forward? Also, aren't there other things he could do, like direct the military to tone down their enforcement of the policy?

Yup, I agree. It seems like he should let the unconstitutionality stand. That seems more powerful that getting Congress to do it. Unless, like you said, he thinks it will later be ruled constitutional.
